An apparel company in Argentina filed suit against LIV Golf and Phil Mickelson for trademark infringement, claiming the logo of Mickelson’s HyFlyers team is “nearly identical” to theirs.

The lawsuit was filed last week in district court in New Jersey by Cool Brands Supply, a skateboard lifestyle apparel company.

Attorneys for the company allege that HyFlyers’ “adoption and use of their knockoff logo nearly twenty years after Plaintiff commenced use and in the face of Plaintiff’s federal trademark registration is not just reckless and inexplicable — it is willful infringement and unfair competition.”

Mickelson is captain of HyFlyers, which also includes James Piot, Brendan Steele and Cameron Tringale. HyFlyers began using their new logo this season after undergoing scheme and color design rebranding following 2022.

“The similarities between the two marks, particularly when used on clothing, are striking, and are confusing consumers and causing damage to Plaintiff’s senior mark and brand,” Cool Brands Supply’s attorneys wrote in the suit. “Plaintiff previously demanded that Defendants cease use of their infringing logo, and they refused.”
